Acceptable use

Overview

The Centre for Equitable Library Access (CELA) provides accessible reading materials and related services to people with print disabilities in Canada.

This Acceptable Use Policy (“Policy”) applies to all users including but not limited to, individuals who browse celalibrary.ca or bibliocaeb.ca and individuals who contact CELA through any medium, including vendors, merchants, contributors of Content and Eligible Users (“Users”).

Eligible users include people with print disabilities, as well as library staff, educators, designates, and other professionals supporting people with print disabilities who either have an account or who are eligible for an account with CELA (“Eligible Users”).

This Policy sets out the terms under which Users may access celalibrary.ca, bibliocaeb.ca or who use celalibrary.ca, bibliocaeb.ca, Content and related services.

By accessing or using celalibrary.ca, bibliocaeb.ca or any Content or services provided by CELA, Users consent to and agree to comply with this Policy. If Users do not agree, they must not access celalibrary.ca or bibliocaeb.ca, or use any Content or services provided by CELA.

Ownership and Use of Content

All content available through celalibrary.ca and bibliocaeb.ca, including text, data, graphics, photographs, images, audio, video, software, trademarks, service marks, trade names, Accessible Works and other materials (collectively, the “Content”), is owned by CELA, its affiliates, and/or third-party licensors or partners.

The Content is protected by Canadian and international copyright and trademark laws.

Accessible works are copyrighted works made available in accessible formats and are restricted by law or license agreement that use must be for people with print disabilities or perceptual disabilities as defined by Canada's Copyright Act (“Accessible Works”).

CELA’s Accessible Works are provided solely for Eligible Users. People with print disabilities may use CELA’s Accessible Works for personal use; all other Eligible Users may obtain access to and use the Accessible Works to support an individual with a print disability.

Except as permitted by this Policy or by applicable law, Users may not copy, reproduce, modify, publish, transmit, distribute, share, display, perform, sell, or create derivative works from any Content with or to individuals or organizations who are not Eligible Users of CELA services without the prior written consent of CELA. To request written consent, please contact CELA by email at members@celalibrary.ca.

Copyright Compliance and Monitoring

CELA uses visible and invisible digital identifiers within its Accessible Works to support copyright compliance and to investigate potential misuse.

Users agree not to remove, alter, or interfere with these identifiers.

CELA may investigate suspected violations of the Terms of Acceptable Use Policy, consistent with CELA’s Privacy Policy. If CELA determines, in its discretion, that a User has violated this Policy, applicable law, or the rights of CELA or third parties, CELA may suspend or terminate access to CELA services, either temporarily or permanently.

Privacy

CELA is committed to preserving and safeguarding the privacy of its Users.

Personal information is collected, used, disclosed, and otherwise managed in accordance with applicable privacy legislation and as described in CELA’s Privacy Policy. CELA’s Privacy Policy forms part of these terms.

Links to Other Websites

CELA may provide links to websites that are owned, operated, or maintained by organizations that are not affiliated with CELA. These websites are independent of CELA, and CELA does not control their content, policies, or practices.

CELA does not endorse and makes no representations or warranties regarding the accuracy, reliability, accessibility, or completeness of information on external websites. Accessing and using linked websites is at the User’s own risk.

The presence of a link does not imply sponsorship, endorsement, or affiliation with CELA.

Disclaimer

CELA services and Content are provided on an “as is” basis. While CELA works to provide reliable and accessible services and Content, we do not guarantee that the services and Content will be uninterrupted, error-free, or free of defects.

To the fullest extent permitted by law, CELA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

If a User is dissatisfied with celalibrary.ca, bibliocaeb.ca, CELA services or Content or this Policy, their sole remedy is to discontinue access or use.

Limitation of Liability

To the fullest extent permitted by law, CELA will not be liable for any direct, indirect, incidental, consequential, or special damages arising from the access to, use of, inability to access or inability to use, celalibrary.ca, bibliocaeb.ca, its Content, or services.

CELA is not responsible for the conduct of other Users or for any damage to equipment, systems, or data resulting from access to or use of celalibrary.ca, bibliocaeb.ca.

Indemnification

Users are responsible for their access to celalibrary.ca and bibliocaeb.ca, and their use of CELA services and Content and agree to indemnify and hold harmless CELA, its affiliates, members, directors, officers, employees, agents, licensors, publishers, and content owners from any claims, losses, damages, liabilities, or expenses arising from their access or use of celalibrary.ca, bibliocaeb.ca, its Content, or services, any violation of this Policy, or any infringement of the rights of others.

Changes and Service Availability

CELA may modify, suspend, or discontinue celalibrary.ca, bibliocaeb.ca, its Content, or services at any time, temporarily or permanently.

Updates to this Policy

CELA may update this Policy from time to time. The revised version will be posted on our website with the new effective date. We will notify Users on our mailing list via email of the updated Policy. Continued contact with CELA, browsing, accessing or using celalibrary.ca or bibliocaeb.ca, or use of CELA services after this Policy is updated constitutes acceptance of the revised Policy.

Governing Law

This Policy is governed by the laws of the Province of Ontario and the laws of Canada applicable therein. If any provision of this Policy is found to be unenforceable, the remaining provisions of this Policy will continue in full force and effect.
